Posting means a foreign employer temporarily sending a worker to Poland. It comes with specific obligations – different for EU companies and non-EU ones.
Posting from the EU/EEA
The worker must be guaranteed Polish minimum employment conditions (pay, working time, leave, etc.). The posting is notified to the National Labour Inspectorate (PIP), and social security is confirmed by an A1 certificate from the home country. You also appoint a contact person in Poland.
Posting from outside the EU
Third-country workers posted to Poland additionally need a basis to work – usually a type C, D or E work permit plus legal residence. See work permit.
The foreign employer's obligations
- notifying the posting to PIP,
- keeping documentation (contract, working-time records) and making it available on request,
- ensuring conditions no worse than the Polish minimum.
